CASE STUDY – I
Nepasoft is a software company of Nepal that develops various MIS software. Mr. Nick is hired as an MIS software engineer at Nepasoft. His first project was to assist in writing the code for School MIS System with payroll. He had previously worked on a similar project interning at a startup and had written a code. Nick re-uses this same code in the Nepasoft product, and does not think to tell anyone that he has used the code from his previous job. His manager is excited with this code brings to the product.
Before the product is released, it has to undergo various steps of quality testing and product quality assurance process review. During the testing of the product, it was found the code which Nick developed had been copyrighted by the startup he had previously worked for. Even though Nick had developed the code, his previous company still owned the intellectual property rights to it.
When his boss informed Nick of the problem, Nick admits he did not realize he had made a mistake because he was not familiar with copyright laws. Nick then goes on to explain that the start-up he used to work for is now out of business and is unsure if Nepasoft would be able to get in contact with the owner of the copyright. If Nepasoft could not be Nick code, then it will have to rewrite the entire code of the MIS, delaying its release by few months.
